Fatwa

Below is a brief Shar‘ī outline regarding the estate of the late Hafiz Yakub RA.

Firstly, it is important to note that in Islam, ensuring that our wealth, estates, and dealings are aligned with the teachings of Sharī‘ah is fard upon every believer.

Rasūlullāh ﷺ strongly warned against consuming or withholding another person’s rightful wealth. Any wealth withheld unjustly will stand against a person on the Day of Qiyāmah. To gain temporary benefit at the cost of eternal loss is neither wise nor permissible.

At the time of the passing away of Hafiz Yakub RA, the heirs were: 1 wife, 3 sons, and 1 daughter. According to Sharī‘ah:

We strongly advise that the family sit together in the presence of a qualified Mufti or Shar‘ī body so that the estate is distributed correctly.

Any continued delay or withholding of rightful inheritance is sinful, and all involved will be accountable in the Court of Allah.

May Allah Ta’ālā grant clarity, unity, and justice to all parties.
